Terms of Service

By creating an account, using any feature of the CrashPads platform, submitting a booking request, listing a property, or clicking "I agree," you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional policies referenced herein.

If you do not agree, you may not use CrashPads. If you are using CrashPads on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

• "CrashPads," "we," "us," or "our" means the operator of the platform at crashpads.io.
• "User," "you," or "your" means any person who accesses or uses the platform, whether as a Guest, Host, or visitor.
• "Guest" means a User who searches for, requests, or books accommodation through CrashPads.
• "Host" means a User who lists a space for rent through CrashPads.
• "Listing" means any accommodation, property, space, or service offered for booking on the platform.
• "Booking" means a confirmed reservation between a Guest and a Host made through CrashPads.
• "Platform" means the CrashPads website, mobile experience, booking system, messaging tools, payment system, and related services.
• "Content" means any text, photos, reviews, messages, listings, or other information submitted by a User to the platform.

CrashPads is an online marketplace that connects traveling professionals with hosts offering short-term, work-ready accommodations. CrashPads is not a hotel, property manager, landlord, insurer, broker, employer, or travel agency.

CrashPads does not own, manage, operate, inspect, or control any Listing. All Bookings are agreements directly between the Guest and Host. CrashPads facilitates the connection, handles payment processing, and provides platform tools — it is not a party to the stay itself.

To use core platform features — including booking a stay or listing a space — you must create an account by providing accurate, complete, and current information. You agree to update your account information whenever it changes.

You may register as a Guest, a Host, or both. Hosts are additionally subject to the Host Terms & Conditions.

CrashPads reserves the right to reject, suspend, or terminate any account at our discretion, including if registration information is found to be false, misleading, or incomplete.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share your password or allow others to access your account.

If you suspect unauthorized access to your account, you must notify us immediately at support@crashpads.io. CrashPads is not liable for losses arising from unauthorized account use unless directly caused by our negligence.

To use CrashPads, you must:

1. Be at least 18 years of age, or the age of majority in your jurisdiction — whichever is greater.
2. Have the legal capacity to enter into binding contracts.
3. Not be prohibited from using the platform under applicable law.
4. Not have had a prior CrashPads account suspended or terminated for cause.

By using the platform, you represent and warrant that you meet all eligibility requirements.

Guests may search Listings, submit booking requests, communicate with Hosts, make payments, and leave reviews for Hosts and properties. Guests agree to follow all applicable House Rules for any space they book, treat the property with care, and comply with these Terms.

Hosts may create Listings, set pricing and availability, accept or decline booking requests, communicate with Guests, and receive payouts. Hosts are additionally bound by the Host Terms & Conditions.

A single account may act as both a Guest and a Host. Each role carries its own set of obligations under the applicable terms.

When a Host confirms a booking request, a binding agreement is formed directly between the Guest and Host for the stay described in the Listing. CrashPads is not a party to that agreement.

Guests are responsible for reading the full Listing description, House Rules, and any applicable policies before requesting to book. Submitting a booking request constitutes acceptance of those terms.

CrashPads may, at its discretion, cancel any Booking that it determines violates platform policies, poses a safety risk, or involves fraudulent activity.

For Guests: CrashPads charges zero guest service fees. The price shown on a Listing is the all-inclusive nightly rate — there are no booking fees, no cleaning fees, and no hidden charges added at checkout. You pay exactly what the Listing shows.

For Hosts: CrashPads charges a flat 12% service fee on each completed booking. This fee is deducted from the payout before it is issued. There are no subscription fees, no setup costs, and no fees on cancellations. Payouts are issued within 24 hours of Guest check-in via direct deposit.

All payments are processed through CrashPads' payment processor. By making or receiving a payment on the platform, you agree to the payment processor's terms in addition to these Terms.

Cancellation terms are set by the Host for each Listing and are displayed before booking. CrashPads may override a Listing's cancellation policy where required by law, platform safety policy, or significant Host misrepresentation.

Guests who cancel within the refund window described on the Listing are entitled to the stated refund. Hosts who cancel confirmed bookings without valid cause may be subject to fees, ranking penalties, or account action.

In cases of emergency, natural disaster, or government restriction that prevents a stay from occurring, CrashPads' extenuating circumstances policy may apply.

CrashPads automatically generates an expense-ready invoice for every confirmed booking. Invoices include the property address, stay dates, nightly rate, total charge, and a unique invoice number. No additional receipt requests are necessary — the invoice is available to both Guest and Host from the moment the booking is confirmed.

CrashPads invoices are formatted to meet standard corporate expense policy requirements. CrashPads makes no guarantee that any specific employer, client, or expense platform will accept a CrashPads invoice without adjustment.

CrashPads requires Hosts to complete identity verification before their Listings are made public. Guest identity verification may be required at the time of booking or as a condition of using certain platform features.

Verification reduces fraud and improves safety for the entire community. However, CrashPads does not guarantee the identity, background, conduct, or suitability of any User. You interact with other Users at your own risk.

After a completed stay, Guests may review Hosts and properties, and Hosts may review Guests. Reviews must be honest, accurate, and based on a genuine first-hand experience.

You may not post fake reviews, offer undisclosed incentives for positive reviews, retaliate against another User for an honest review, or use reviews to harass or defame. CrashPads may remove reviews that violate these rules.

Reviews are a two-way accountability system. Both Hosts and Guests benefit from a trustworthy review environment and are expected to contribute to it honestly.

You agree not to:

• Provide false or misleading information in your account, Listing, or booking request.
• Use the platform for any unlawful purpose or in violation of applicable laws.
• Harass, threaten, intimidate, defame, or abuse any other User.
• Circumvent the platform by arranging off-platform payments for bookings.
• Scrape, copy, or misuse platform data, algorithms, or intellectual property.
• Use automated tools, bots, or scripts to access or interact with the platform.
• Attempt to gain unauthorized access to other accounts or platform systems.
• Post content that is defamatory, obscene, discriminatory, or violates third-party rights.
• Discriminate against other Users based on any legally protected characteristic.
• Attempt to manipulate ratings, reviews, or search results.

CrashPads may suspend or permanently remove accounts that violate these prohibitions.

You retain ownership of the content you submit to the platform. By posting content, you grant CrashPads a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, store, reproduce, display, distribute, and create derivative works from your content for purposes of operating, marketing, and improving the platform.

You represent that you have all rights necessary to grant this license and that your content does not violate any third-party rights, applicable law, or these Terms. CrashPads may remove any content that violates these Terms or our community standards.

The CrashPads platform, including its name, logo, design, software, codebase, features, and platform-generated content, is owned by CrashPads or its licensors and is protected by intellectual property law.

You may not copy, reproduce, reverse engineer, decompile, scrape, frame, or create derivative works from any part of the platform except as expressly permitted by these Terms or applicable law.

Your use of CrashPads is subject to our Privacy Policy, which describes how we collect, use, store, and share your personal information. By using the platform, you consent to our data practices as described in that policy.

Users must handle other Users' personal data responsibly and only use it for legitimate platform purposes — booking a stay, communicating about a Booking, or complying with law. Selling, sharing, or publishing another User's personal information is strictly prohibited.

By creating an account, you consent to receive transactional communications from CrashPads including booking confirmations, receipts, invoices, policy updates, and service notifications. You may opt out of marketing communications at any time.

CrashPads may monitor platform messages where permitted by law to prevent fraud, enforce these Terms, investigate disputes, and improve platform safety.

The platform may link to or integrate with third-party services, including payment processors, mapping services, and identity verification providers. These third parties have their own terms and privacy policies. CrashPads is not responsible for the content, availability, or practices of third-party services.

CrashPads strives to maintain platform availability but does not guarantee uninterrupted or error-free access. The platform may be temporarily unavailable due to maintenance, technical issues, security incidents, or circumstances beyond our control.

CrashPads is not liable for losses resulting from platform downtime, outages, bugs, data loss, or service interruptions.

CrashPads provides the platform "as is" and "as available" without warranties of any kind — express, implied, or statutory. We do not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses.

We do not guarantee the accuracy of Listing descriptions, the conduct of Hosts or Guests, the outcome of bookings, the enforceability of House Rules, or the suitability of any accommodation for any particular purpose.

To the fullest extent permitted by applicable law, CrashPads shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the platform — including but not limited to damages from booking disputes, Host or Guest conduct, property damage, personal injury, loss of data, or platform interruptions.

CrashPads' total cumulative liability for any claim arising out of or related to these Terms or the platform will not exceed the greater of: (a) the total fees paid by you to CrashPads in the three months prior to the claim; or (b) one hundred US dollars ($100).

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless CrashPads, its affiliates, officers, directors, employees, contractors, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your Content, your breach of these Terms, or your violation of any law or third-party rights.

CrashPads may, at its discretion and with or without prior notice, limit, suspend, deactivate, or permanently terminate your account if we determine that you have violated these Terms, violated applicable law, posed a safety risk, engaged in fraud, received serious complaints, or acted in a manner inconsistent with our community standards.

You may close your account at any time by contacting us at support@crashpads.io. Account closure does not relieve you of obligations arising before termination, including outstanding payments, pending bookings, or tax obligations.

Disputes between Guests and Hosts are primarily the responsibility of the parties involved. CrashPads encourages Users to resolve issues directly through platform messaging.

CrashPads may, but is not obligated to, assist in resolving disputes and may make platform-level decisions about refunds, payouts, reviews, or account standing. These decisions are final within the platform. CrashPads is not acting as a court, arbitrator, mediator, or legal authority in any User dispute.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable mandatory consumer protection law in your jurisdiction requires otherwise.

You and CrashPads agree to first attempt to resolve any dispute informally by contacting support@crashpads.io and allowing 30 days for good-faith resolution before initiating formal proceedings.

If a dispute is not resolved informally, you and CrashPads agree to resolve it through binding individual arbitration — not through a class action, collective proceeding, or jury trial — except where prohibited by applicable law.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction, filing in small claims court where permitted, or reporting issues to a government authority.

CrashPads may update these Terms from time to time. When we make material changes, we will notify you by email, platform notification, or by posting the updated Terms at crashpads.io/terms with a revised "Last Updated" date.

Your continued use of the platform after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the platform and close your account.

These Terms, together with the Privacy Policy, Host Terms & Conditions (for Hosts), Payment Terms, and any other policies posted on the platform, constitute the entire agreement between you and CrashPads regarding your use of the platform and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
