These terms govern your access to and use of CrashPads as a host. Platform: CrashPads — crashpads.io. Contact: support@crashpads.io
For purposes of these Host Terms:
CrashPads provides an online platform that allows Hosts and Guests to connect, communicate, and arrange room-sharing or crash pad accommodations. CrashPads is not the owner, operator, landlord, tenant, hotel, property manager, broker, insurer, employer, or agent of any Host or Guest unless expressly stated in writing.
Hosts are solely responsible for their Listings, properties, house rules, legal compliance, taxes, insurance, safety, and interactions with Guests.
To host on CrashPads, you must:
You represent and warrant that you have full legal authority to list the space and accept Guests. This means, as applicable, that you own the property, or you have written permission from the property owner, landlord, or other required party; and your Listing does not violate any lease, rental agreement, mortgage restriction, or other obligation.
You are responsible for ensuring your Listing is truthful, complete, current, and not misleading. Each Listing must accurately disclose the type of accommodation, sleeping arrangements, shared areas, amenities, house rules, all fees, deposits, and any conditions that could materially affect a Guest's decision to book.
You may not post false photos, hide required disclosures, use bait-and-switch pricing, misrepresent the property, or advertise amenities that are not provided.
Because CrashPads focuses on room sharing and temporary shared accommodations, Hosts must be especially clear about privacy and shared living conditions. You must disclose whether Guests will share bedrooms, bathrooms, kitchens, living rooms, entrances, or sleeping areas, and the number of expected occupants.
You may not list or offer: any property you do not have authority to provide; unsafe, unsanitary, illegal, or uninhabitable spaces; spaces that violate occupancy, fire, building, zoning, housing, or short-term rental laws; spaces with hidden cameras or undisclosed monitoring devices; or listings that discriminate unlawfully.
CrashPads may remove any Listing at any time if we believe it violates these Host Terms, our policies, or applicable law.
Hosts are solely responsible for understanding and complying with all laws that apply to their Listings and hosting activity, including short-term rental laws, landlord-tenant laws, zoning laws, registration and permit requirements, tax collection and reporting rules, and fair housing and anti-discrimination laws.
CrashPads does not provide legal, tax, insurance, or real estate advice.
Before listing on CrashPads, you must determine whether your city, county, state, building, landlord, HOA, or other authority requires registration, permits, licenses, inspections, taxes, or approvals. You are responsible for obtaining and maintaining all required permissions.
You are solely responsible for determining, collecting, reporting, and paying any taxes related to your hosting activity, except where CrashPads expressly states that it will collect or remit certain taxes on your behalf. You agree to provide accurate tax forms and taxpayer information when requested.
You are responsible for setting your Listing price. You authorize CrashPads or its payment processor to collect booking amounts from Guests and deduct applicable CrashPads service fees, payment processing fees, refunds, adjustments, chargebacks, taxes, penalties, or other amounts owed before issuing Host payouts.
CrashPads may withhold, delay, offset, or reverse payouts if a Guest cancels and is entitled to a refund, a chargeback or fraud claim occurs, you violate these Host Terms, or CrashPads is required to do so by law.
Hosts may not request, solicit, or accept off-platform payments for booking charges, required fees, deposits, or extensions unless CrashPads expressly allows it in writing. CrashPads may remove Listings, cancel bookings, withhold payouts, or suspend accounts for off-platform payment activity.
If CrashPads allows security deposits or damage claims, Hosts must disclose them clearly before booking. Damage claims must be submitted within the timeframe required by CrashPads policy and must include reasonable documentation. Normal wear and tear is not chargeable to Guests.
Hosts should not cancel confirmed bookings except when necessary due to emergency, safety concerns, legal requirements, property damage, force majeure, Guest policy violations, or other valid reasons. If you cancel a confirmed booking without valid cause, CrashPads may charge cancellation fees, reduce your ranking, block the canceled dates, or suspend your Listing or account.
Guest cancellations are governed by the cancellation policy selected for the Listing and any applicable CrashPads refund policy. CrashPads may override a Listing cancellation policy where required by law, platform policy, safety concerns, significant misrepresentation, or other exceptional circumstance.
You must make the booked space available to the Guest as described in the Listing and confirmed Booking. You must provide accurate check-in instructions, access codes, keys, parking instructions, contact information, and emergency procedures.
You must provide a clean, safe, sanitary, and habitable space. Sleeping areas must be clean and prepared, bathrooms and shared areas must be sanitary, and all heating, cooling, water, electricity, locks, and basic fixtures must work as represented.
Hosts are responsible for maintaining a safe environment, including working smoke detectors, carbon monoxide detectors where applicable, fire extinguishers, clearly marked exits, functioning locks, adequate lighting, and safe electrical, plumbing, heating, and cooling systems.
Hosts must respect Guest privacy. You may not use hidden cameras, undisclosed recording devices, or surveillance in private spaces. You must disclose all cameras, recording devices, smart doorbells, noise monitors, and security systems before booking. CrashPads may immediately remove any Host who violates privacy or surveillance rules.
Hosts must comply with all applicable fair housing, civil rights, and anti-discrimination laws. You may not refuse, cancel, impose different terms, harass, discourage, or treat Guests differently because of legally protected characteristics, including race, color, religion, national origin, sex, sexual orientation, gender identity, disability, familial status, age, or other categories protected by law.
Hosts must comply with applicable accessibility, disability accommodation, and service animal laws. Where required by law, Hosts must make reasonable accommodations for Guests with disabilities and must not charge unlawful pet fees for service animals.
Hosts may create reasonable house rules, provided they are lawful, clearly disclosed before booking, and applied consistently. House rules may cover quiet hours, smoking, pets, visitors, parking, shared spaces, kitchen and laundry use, check-in and check-out times, and maximum occupancy.
Hosts must act professionally, honestly, and respectfully. You agree not to harass, threaten, intimidate, or abuse Guests; enter a Guest's private space without consent; misrepresent booking terms; pressure Guests to cancel; retaliate against Guests for complaints or reviews; or engage in illegal activity at the Listing.
CrashPads may offer identity verification and other screening tools, but Hosts are responsible for deciding whether to accept a booking. CrashPads does not guarantee any Guest's identity, background, behavior, financial ability, or suitability. Hosts must use Guest information only for legitimate booking, safety, legal, or platform purposes.
Hosts may leave honest, accurate, and respectful reviews based on real experiences. You may not post fake reviews, manipulate reviews, pressure Guests to leave positive reviews, retaliate for negative reviews, or offer undisclosed incentives for reviews.
You are solely responsible for obtaining and maintaining appropriate insurance for your hosting activity. Homeowner's, renter's, landlord, umbrella, or business insurance may not cover short-term rentals, paid guests, shared accommodations, property damage, injuries, theft, or liability.
You must promptly address maintenance issues, safety concerns, utility outages, access problems, pest issues, water leaks, lock failures, and other material problems. For emergencies, contact appropriate emergency services first, then notify CrashPads as soon as reasonably possible.
You must promptly report significant property damage, injuries, threats, illegal conduct, safety incidents, police activity, fire, flooding, theft, privacy violations, or other serious incidents related to a Booking. You agree to cooperate with CrashPads, insurers, payment processors, and law enforcement in investigating and resolving incidents.
You own your Host Content, but you grant CrashPads a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify, display, distribute, translate, promote, and create derivative works from your Host Content for purposes of operating, marketing, improving, and protecting the platform.
CrashPads and its logos, names, designs, software, platform features, and content are owned by CrashPads or its licensors. You may not copy, modify, reverse engineer, scrape, misuse, or use CrashPads intellectual property except as permitted by these Host Terms.
Hosts must handle Guest personal information responsibly. You may use Guest information only to provide the booked accommodation, communicate about the Booking, comply with law, resolve disputes, or protect safety. You may not sell Guest information, add Guests to marketing lists without consent, or publish Guest information.
CrashPads may require Hosts and Guests to communicate through platform messaging for safety, recordkeeping, and support. You agree that CrashPads may review platform communications where permitted by law to prevent fraud, enforce terms, provide support, investigate disputes, or improve safety.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify CrashPads immediately at support@crashpads.io if you suspect unauthorized access, fraud, or misuse.
CrashPads may, with or without notice, limit, suspend, deactivate, or terminate your account or Listing if we believe you have violated these Host Terms, violated law, created risk, harmed the platform, received serious complaints, failed verification, engaged in fraud, or acted inconsistently with CrashPads community standards.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CrashPads, its affiliates, officers, directors, employees, contractors, agents, payment processors, and partners from and against any claims, demands, damages, losses, liabilities, costs, fines, penalties, and expenses arising out of or related to your Listing or hosting activity, your breach of these Host Terms, or your violation of law or third-party rights.
To the fullest extent permitted by law, CrashPads is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from Host-Guest interactions, Listings, Bookings, cancellations, payment delays, disputes, reviews, or platform interruptions. CrashPads' total liability for any claim will not exceed the greater of: (a) Host fees paid by you to CrashPads in the three months before the claim; or (b) $100.
CrashPads provides the platform "as is" and "as available." CrashPads does not guarantee that the platform will be uninterrupted, error-free, secure, profitable, or free from fraud or misconduct. CrashPads does not guarantee any Guest, booking volume, payout amount, listing ranking, tax outcome, legal compliance, review, or dispute result.
Hosts and Guests are encouraged to resolve issues directly and respectfully through CrashPads messaging. CrashPads may, but is not required to, assist in disputes. CrashPads may make platform-level decisions about refunds, payouts, reviews, claims, account status, or policy enforcement, but CrashPads is not acting as a court, arbitrator, insurer, landlord, or property manager.
These Host Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable law requires otherwise.
You and CrashPads agree to first attempt to resolve disputes informally by contacting support@crashpads.io. If a dispute cannot be resolved informally, either party may pursue binding arbitration, except where prohibited by law. Disputes will be handled individually and not as a class or representative action.
Nothing in this section prevents either party from seeking emergency injunctive relief, filing in small claims court where permitted, or reporting issues to government authorities.
CrashPads may update these Host Terms from time to time. If changes are material, CrashPads may provide notice by email, platform notification, or posting an updated version at crashpads.io. Your continued use of CrashPads after changes become effective means you accept the updated Host Terms.
You may stop hosting at any time by removing your Listings and closing your account, subject to any confirmed bookings, payout obligations, refunds, disputes, taxes, or legal obligations. You remain responsible for obligations that arose before termination.
Sections related to taxes, payouts, disputes, indemnification, limitation of liability, intellectual property, privacy, enforcement, governing law, arbitration, and any obligations that by their nature should survive will continue after your account is closed or these Host Terms end.
These Host Terms, together with the CrashPads Terms of Service, Privacy Policy, Payment Terms, Community Standards, and other posted policies, form the agreement between you and CrashPads regarding hosting on the platform at crashpads.io.
If any provision is found unenforceable, the remaining provisions will remain in effect.
By creating a Host account, publishing a Listing, accepting a Booking, or receiving a payout through CrashPads, you acknowledge that:

By creating a Host account, publishing a Listing, accepting a Booking, or receiving a payout through CrashPads, you electronically accept these Host Terms and Conditions in full — no physical signature is required. Your continued use of the platform constitutes ongoing acceptance of the most current version of these terms.
